Terms and Conditions
Welcome to FlexiRent. This document constitutes a legal agreement between the user (“User” or “You”) and Living Insider Co., Ltd. (“Company” or “We”) as the service provider of the FlexiRent platform, which includes both the website and mobile application. By accessing or using this platform, you acknowledge that you have read, understood, and unconditionally accepted these terms and conditions.
If you do not agree with any of the terms, please discontinue use of our platform immediately.
- 1. Definitions
- 1.1 Platform: Refers to the FlexiRent service system on both the website and mobile application provided by the Company.
- 1.2 Partner: Refers to a property developer or a real estate agency (as a legal entity) that has entered into a contract and lists properties on the platform.
- 1.3 Lessor: Refers to a Partner who is the lawful owner or has legal rights to rent out a listed property on the platform.
- 1.4 Tenant: Refers to a person who books and rents accommodation through the platform.
- 1.5 Admin: Refers to company personnel assigned to manage operations, coordinate, and assist users on the platform.
- 1.6 Booking Fee: A non-refundable amount paid by the Tenant to confirm the booking and reserve the property for a specific period.
- 1.7 Security Deposit: Money paid by the Tenant to the Lessor as a guarantee against potential damage to the property.
- 1.8 Rental Agreement: The residential lease contract entered directly between the "Lessor" and the "Tenant"; the platform is not a party to this contract.
- 2. How the Platform Works
- 2.1 Property Listing: Initially, property listings will be posted by Admins based on Partner-provided information to ensure quality and accuracy. Future development may allow Partners to manage listings themselves.
- 2.2 Booking: Tenants may browse and express interest in rooms through the platform.
- 2.3 Coordination: Admins will liaise with Partners to verify room availability and confirm details before notifying the Tenant.
- 2.4 Booking Fee Payment: If booking proceeds, the Tenant must pay the Booking Fee within 1 hour through the system to confirm the reservation. Failure to pay on time will result in automatic cancellation.
- 2.5 Contract Preparation: After payment of the Booking Fee, the Tenant must complete personal information and submit necessary documents through the platform for contract preparation.
- 2.6 Remaining Payment: The Tenant must pay the remaining amount (first month's rent and Security Deposit minus the Booking Fee) at least 7 days before the lease start date through the platform’s specified channels.
- 2.7 Non-Payment: Failure to pay within the specified timeframe will result in cancellation of the booking, and the Booking Fee will be forfeited.
- 2.8 Monthly Rent Payment: Ongoing rent payments must be made via the platform’s system in accordance with the billing cycle.
- 2.9 Lease Renewal: Lease renewal must be requested through the platform in accordance with the conditions specified in the Rental Agreement.
- 3. User Responsibilities
- 3.1 Users must provide true, accurate, and up-to-date information and are responsible for maintaining the security of their account and password.
- 3.2 The platform must not be used for illegal activities, rights violations, or actions that disrupt public order.
- 4. Obligations of Lessors and Tenants
- 4.1 Lessor: Must legally own or be entitled to rent the property. Responsible for preparing a clean, functional room with operational appliances and facilities before handover, including handling all related taxes.
- 4.2 Tenant: Must pay as per the agreed terms, maintain the rented property in good condition, and return it in its original state at the end of the lease, accounting for normal wear and tear.
- 5. Handling of Security Deposit
- 5.1 The Security Deposit will be held by the platform as an intermediary.
- 5.2 The platform will return the Security Deposit to the Tenant within 7–14 business days after lease termination and Lessor’s confirmation of no damage.
- 5.3 In the event of a dispute over deposit deductions, the Lessor must provide damage evidence and repair estimates. The platform will act as a preliminary mediator based on provided evidence.
- 6. Service Fees and Taxes
- 6.1 The platform will collect a Service Fee from the Lessor as a percentage of total rental income over the lease period.
- 6.2 The Lessor is responsible for managing and paying any taxes on rental income as required by law.
- 7. Intellectual Property and Content Usage
- 7.1 Users (especially Lessors) affirm ownership or full rights to content (e.g., photos, texts, videos) submitted to the platform and grant the platform rights to use, reproduce, adapt, and publish such content for operational and marketing purposes.
- 7.2 All intellectual property appearing on the platform—including logos, designs, text, graphics, and software—is the sole property of Living Insider Co., Ltd. and may not be reproduced, modified, or used without written permission.
- 8. Cancellation Policy
- 8.1 Tenant Cancellations:
- The Booking Fee is non-refundable under any circumstances, as it compensates for lost rental opportunities.
- Exception: A full refund (Booking Fee + any prepayments) will be granted only if the property is found to significantly differ from its photos or details during an in-person inspection on the agreed viewing date. The Tenant must notify the Lessor or Admin immediately onsite.
- 8.2 Lessor Cancellations:
- If the Lessor fails to provide the accommodation after full payment by the Tenant, FlexiRent will refund the full amount and may offer alternative options where appropriate.
- 8.3 Automatic Cancellations:
- Bookings will be automatically canceled if the Booking Fee is not paid within 1 hour or the remaining balance is not paid 7 days before the check-in date.

- 9. Limitation of Liability
- The platform acts solely as an intermediary and is not a direct party to the Rental Agreement. We are not liable for any actions or damages between Tenant and Lessor.
- 10. Dispute Resolution
- Disputes between Tenant and Lessor shall follow the Rental Agreement. The platform may assist in preliminary mediation. Any disputes involving the platform are governed by Thai law and fall under Thai court jurisdiction.
- 11. Amendments
- The Company reserves the right to modify these terms at any time, with prior notification to users through appropriate channels. Continued use of the platform after changes implies acceptance of the new terms.
